The media seem only to report bad-news stories and solicitors now offer no-win, no-fee arrangements that removes much of the risk of taking legal action against practitioners.
The consequences of a single incident could therefore be very serious.
Currently, very few physiologists enjoy the security of a professional indemnity insurance policy. Such a policy would include:
- a medico-legal advice line
- complaint handling assistance and support and representation at disciplinary hearings
- assistance, support and representation with claims
- help at a coroner’s court
Physiologists working full-time in the NHS should remember that the NHS Litigation Authority exists to compensate patients who are injured whilst receiving NHS care – but it has no remit to protect or support any practitioners involved. Soon, the physiology professions will be incorporated into a single regulatory body, the Health Professions Council, and indemnity insurance is likely to become compulsory.
